Will of Austin O’Malley, merchant, of Ormskirk, Lancashire and affidavit sworn by a witness to the will, Edward Joyce, lodging house keeper of Ormskirk, 1848. At this date, all wills in England had to be “proved” [accepted as being legal and genuine] in the consistory courts of the Church of England, regardless of whether the person who made the will was an Anglican or not. The affidavit sworn by Edward Joyce is a key part of this process. Austin O’Malley had died on 6 January, and as his will was written the same day, this suggests that death was rapid and possibly unexpected. The will was proved on 10 April 1848. An unusual feature of this will is that it gives a detailed connection back to Ireland, as O’Malley is the owner of a house “two story high with a back yard and stable…in Bridge Street in Westport” in Co.Mayo. The tenant of the house Patrick O’Malley, may well have been a relative as he was to be give remission of rent under the terms of the will. Indications are that this O’Malley family were reasonably well off. Austin’s brother was a priest, Rev. Edmund O’Malley, and a note on the back of the will records that Austin himself was a merchant. The bequest to his wife, Bridget, leaves her capital with which “to Trade”. The combined bequests in the will total a reasonable sum, although a note on the will notes that the property within the Diocese of Chester did not exceed £300. This value excludes the property in Westport. |
